No the prior art does not need to be in patents and if the patent system has done its job, it will not be. While it could be in old expired patents, if it exists it is more likely to be in old magazines or books, posted in a forum post (if a forum was around at the time), or in some other public disclosure. It could have been disclosed in a patent or other public disclosure from a non detector field for example, medical imaging and this is another way prior art exists.
Of course another defence is that the QED is completely different beast and does not use any patented ML strategies but ML probably have some grounds to pursue this.

BTW guys,
a slight modification of the QED's front-end and some additional circuits can be adapted and arranged to work with the Tablet PC/Netbook/Laptop platform too.
The "World's best ground balance technology" (WBGB) can then be implemented on the mentioned processing front-end (>2 GFLOPS horse power).
All the went up to the orbit overpriced detectors can be stuffed into the garbage bin.
This solution is quite cheap & fast feasible.
Detector Controller: $100
Coil: $100
Netbook: $200
Sound card: $60
Software: $0000000000000000000000000000000000000 (f$kin free)

I don't agree with Carl & PJ. It would have been obsessional happened to everyone trying to get into the market. Even when a product would have been developed in the background. As soon as you sell it and would get some market dominance, the evils appear to ride on the success of others. That is a well-known tactic of patent trolls.
That's the reason, why ML is obsessively trying to own every possible metal detecting related science. The latest hit: trying to own natural laws, prior art, re-invented prior art....

And we shouldn't forget, that the real bashing has been started by the evil few ********s, which have a hidden agenda.

I beg your pardon Aziz. Then why has not Tinkerer, Hammerhead, and the many others projects have not been bashed? No one would of said a word bashing the QED if not for Doug, Huego and you bashing Minelab and saying how great the QED was. 3 years ago you all were bragging on how it was a better gold detector than the latest Minelab. So don't go trying to act all innocent now!!! You were with the trio for a few years. That is a fact, so stop playing your games. We know Doug has you in his spew. Name me one, just one gold prospecting forum where he is a welcomed member. That is not including his own forum. That should give you a hint. Do you think every forum has a agenda against Doug? Aziz....Is it possible that ML personnel have seen the QED in action? Maybe to there surprise its good enough for them to take measured steps to obtain this IP before other major players do so (If not in the process already) and also consider with the recent addition to this QED project from another Forum member here.......this has possibly prompted this action to commence without delay. Eventually a great new product will be sold...to who?.....first in best dressed i say.
We all know how hard it is to produce any marketable product, let alone metal detectors, especially if the finances are not there. Other major manufacturers should take note (if not already shown a interest) of this court order action as the underlying reason has been obscured as it seams and i think its still open to negotiations.
Could just be patent infringement overall.......but i can see this being a win-win situation for the QED owner and ML. There will be no way out of this for the QED owner. Basically a trap set up to gain the IP.
The IP will eventually be bought or in this case handed over and the previous owner will be silenced.
Oh, and all this ML bashing will eventually fade away eventually in time.
BTW, ML shares dropped as of yesterday by 2.5%.

the QED is very very dangerous to ML's and other market players profits (including White's)...
The action says all about this.. ain't it?
I don't speculate. We have to wait and see the law suit action and the decisions.
But it's a very good advertising for the QED.
